2. Applicability

These Terms of Service ("Terms") govern all use of the StoreScan platform and any related services provided by Ecom Store Growth ("we", "us", "our"). By registering for an account or using any part of the service, you ("the customer", "you") agree to these Terms. If you do not agree, do not use the service.

3. Service description

StoreScan is a web-based tool that analyzes e-commerce stores and provides Conversion Rate Optimization (CRO) reports and recommendations. The service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

4. Account registration

To use StoreScan you must:

• Be at least 18 years old or have legal capacity to enter into contracts.
• Provide accurate and complete registration information.
• Keep your account credentials confidential.
• Notify us immediately of any unauthorized use of your account.

You are responsible for all activity that occurs under your account.

5. Pricing and payment

StoreScan is available under different pricing models — including recurring subscriptions and one-time purchases. Pricing and available plans are published on our website. Unless stated otherwise:

• Subscriptions are billed in advance on a monthly or annual basis and renew automatically until cancelled.
• One-time purchases grant access to the specified product or report for the agreed scope, with no recurring charges.
• Payments are processed via our payment provider. By completing a purchase you authorize us to charge the stated fee to your chosen payment method.
• All prices are exclusive of applicable VAT unless stated otherwise.
• Invoices are sent by email after each successful payment.

6. Cancellation and refunds

You may cancel your subscription at any time via your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for unused subscription time, except where required by applicable law.

Right of withdrawal (EU consumers): If you are a consumer in the EU, you have the right to withdraw from a purchase within 14 days of entering into the agreement, unless you have already made full use of the service and you explicitly waived your right of withdrawal. 7. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable regulations.
• Attempt to reverse engineer, decompile, or extract the source code of the platform.
• Use automated scripts to access the service in a way that disrupts normal operation.
• Resell or sublicense access to the service without our written consent.
• Submit false, misleading, or fraudulent information.

We reserve the right to suspend or terminate accounts that violate these conditions.

8. Intellectual property

All software, content, trademarks, and materials associated with StoreScan are the intellectual property of Ecom Store Growth or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the service during your subscription. This license does not grant ownership of any part of the service.

Data you submit to the platform (store data, reports, etc.) remains yours. You grant us a limited license to process that data solely to provide the service.

9. Disclaimer of warranties

The service is provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or that the results obtained from using the service will be accurate or reliable.

10. Limitation of liability

To the fullest extent permitted by applicable law, Ecom Store Growth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data, arising out of or in connection with your use of the service — even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the total fees paid by you to us in the three (3) months preceding the claim.

11. Privacy

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice within the platform at least 14 days before the new Terms take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or related to these Terms shall be submitted to the competent court in the district of Overijssel, Netherlands, unless mandatory consumer protection laws in your country provide otherwise.
